Vorcaro's plea deal: what we know so far

Daniel Vorcaro has been in pretrial detention since March 4, 2026 (Jornal do Brasil). On March 19, he signed a confidentiality agreement with the Federal Police and prosecutors, the first formal step toward negotiating a plea deal (Wikipédia).

His lawyers submitted more than one version of the proposal. One, on May 6, was delivered on a USB drive. All were rejected. The final word came from the Prosecutor General's Office on June 15, which told the defense it would not negotiate a new proposal (Poder360, Gazetaweb).

On October 9, after a magazine released audio attributed to Vorcaro, the Federal Police said he gave no testimony with the reported content and that his proposals “were not accepted because they did not meet legal requirements”. Prosecutors said “there was no oral testimony” precisely because of the rejection. Why the proposals were rejected

According to the Federal Police, the proposal delivered in May repeated facts that were already known and left out episodes considered central. Investigators also concluded that Vorcaro was trying to protect allies. One of the signs they cited was the lack of information about Senator Ciro Nogueira (PP, Piauí), who is under investigation on suspicion of receiving benefits linked to Master (Brasil de Fato, Jovem Pan).

Prosecutors took the same view. According to the team of Prosecutor General Paulo Gonet, the proposal lacked solid evidence, relied on third-party accounts and included no commitment to return money obtained through the alleged fraud (Poder360, Diário do Grande ABC).

Vorcaro tells a different story. In September, he said the Federal Police refused his plea deal to protect its director-general, Andrei Rodrigues, and reported mistreatment in custody (Wikipedia (EN)).

The plea deal of “Mineiro”

Prosecutors reached a cooperation agreement with Antonio Carlos Freixo Júnior, known as “Mineiro”, owner of Entre Investimentos. According to the Federal Police, the company brokered transfers from Vorcaro meant to fund Dark Horse, a film about Jair Bolsonaro (Congresso em Foco). How plea deals work in Brazil

A plea deal, called colaboração premiada (rewarded cooperation) in Brazilian law, is governed by Law 12,850/2013. The suspect tells what they know and hands over evidence. In exchange, they can receive benefits such as a reduced sentence. The agreement is negotiated with the police or prosecutors and only takes effect once approved by a judge. Because this case is at the Supreme Court, the approval comes from the justice who acts as rapporteur.

A cooperating witness's word alone is not enough. The law forbids basing a conviction, the acceptance of charges or an arrest solely on the witness's statements. Everything must be corroborated by other evidence.

What to watch now

• The Supreme Court ruling. The full court has yet to decide whether the Federal Police report at the center of the crisis is valid. Justice Flávio Dino asked for more time on September 15 and has up to 90 days to return the case (Congresso em Foco).
• The request for release. His lawyers asked for his pretrial detention to be revoked on September 18 (Jornal de Brasília).
• New plea deals by others. Besides “Mineiro”, other suspects have expressed interest in cooperating, such as former BRB CEO Paulo Henrique Costa (Wikipédia).
